COPYRIGHT OFFENSES ALONG WITH THEIR CORRESPONDING SECTIONS AND THE POTENTIAL PUNISHMENTS UNDER THE INDIAN COPYRIGHT ACT, 1957:
Reproduction of Copyrighted Work (Section 51(a)
Anyone who reproduces a copyrighted work without the permission of the copyright owner can be held liable for infringement. This includes making copies of books, music, films, and other protected content.
Punishment: Imprisonment of up to 3 years and/or a fine.
Distribution of Infringing Copies (Section 51(b)
Selling, renting, distributing, or otherwise making available unauthorized copies of copyrighted works is an offense. This includes actions like selling counterfeit DVDs or sharing copyrighted content without authorization.
Punishment: Imprisonment of up to 3 years and/or a fine.
Public Performance and Communication to the Public (Section 51(c) and (d)
Publicly performing or displaying a copyrighted work without permission can be an offense. This applies to performances of music, plays, films, and art in public places without proper licenses.
Punishment: Imprisonment of up to 3 years and/or a fine.
Adaptation and Translation (Section 51(e)
Creating derivative works, adaptations, translations, or remixes of copyrighted works without the consent of the copyright owner is an offense.
Punishment: Imprisonment of up to 3 years and/or a fine.
Publication of Works in Violation of Copyright (Section 63)
This section deals with the unauthorized publication of works that are prohibited under the Copyright Act.
Punishment: Imprisonment of up to 7 years and a fine.
Importation of Infringing Copies (Section 53):
Importing infringing copies of copyrighted works into India without the permission of the copyright owner is an offense.
Punishment: Imprisonment of up to 3 years and/or a fine.
Circumvention of Technological Protection Measures (Section 65A and 65B):
Tampering with digital locks, encryption, or other technological protection measures used to prevent unauthorized access to copyrighted content is an offense.
Punishment: Imprisonment of up to 2 years and/or a fine.
Digital Rights Management Information (Section 65)
Removing or altering digital rights management information, such as copyright notices or author names, with the intent to facilitate infringement can be an offense.
Punishment: Imprisonment of up to 2 years and/or a fine.
Plagiarism and False Attribution:
While not explicitly covered under a single section, passing off someone else’s work as one’s own, such as copying and presenting written content without proper attribution, can be treated as an offense.
Commercial Rental of Copyrighted Works (Section 52)
Commercially renting or leasing copyrighted works, such as books, movies, or video games, without authorization can be an offense.
Punishment: Imprisonment of up to 3 years and/or a fine.
